Legal Notice
This agreement (the “Terms”) governs your access to and use of the Butler platform (the “Platform” or “Butler App”), which is exclusively available as a mobile application. The Platform is provided by Yo Book SARL (“Yo Book,” “we,” “us,” or “our”).
What We Do
The Butler Platform is a digital service operated by Yo Book that connects Restaurants with trusted local experts — "Butlers" — individuals with deep knowledge of the local food scene who guide visitors toward authentic, quality dining experiences. Yo Book acts solely as an intermediary and is not a party to any relationship between the Restaurant and the Butler.
Yo Book SARL
Yo Book SARL is a limited liability company organized under the laws of Morocco, with a registered share capital of One Hundred Thousand Moroccan Dirhams (100,000 MAD), domiciled at C/o Plateau N°04, 1er étage Dar Raiss, Avenue 29 Février, Talborjt – Agadir, Morocco.
Contractual Relationship
Yo Book is not a party to the contracts entered into directly between the “Butlers” and the “Restaurants” and does not act as an agent for any member. However, Yo Book serves as an intermediary, connecting “Butlers” to “Restaurants.”
These general terms and conditions, hereinafter referred to as the “Agreement,” are between the “Butlers” and the “Restaurants.” This Agreement applies exclusively to Butler members who will receive rewards or “commissions” from participating restaurants or other Butler customers, or who are authorized to access this service.
Butler Independence
The relationship between Yo Book and Butlers is that of independent entities or individuals. Butlers are not employees, agents, co-entrepreneurs, or partners of Yo Book. Yo Book does not control or direct the services provided by Butlers. It is understood that Butlers have full autonomy in deciding when and where to provide their services, without any control or direction from Yo Book.

Our mission is to provide a seamless platform for Butlers to identify and reserve restaurants based on their clients' preferences. From fine dining establishments to popular urban hotspots, Butler offers a carefully curated selection tailored to meet diverse needs. Each listing includes detailed descriptions, high-quality images, enticing menus, and precise location information. We are committed to delivering a personalized dining experience, all easily accessible at the touch of a button.
What personally identifiable information do we collect?
When you sign up to access the Butler service, we collect the following categories of personally identifiable information: your name, your email address and your phone number. Searching & Booking on Butler
Search
You are authorized to utilize search functionalities to locate Restaurants based on pre-determined criteria, including, but not limited to, Restaurant name, culinary style, and geographic location within the city, all in accordance with the expressed preferences of your clientele.
Booking
By booking a reservation for your Clients at a Restaurant, you acknowledge your agreement to receive a commission from the Restaurant. This commission will be deducted from the total fees associated with your booking (if applicable), which may include relevant charges such as Butler service fees, applicable taxes or transfer fees, and any other itemized charges presented upon receipt of payment (collectively referred to as the “commission”).
Upon receiving confirmation of the booking, a contract for Restaurant Services (the “Booking”) is established directly between you and the Restaurant. In addition to these Terms of Use, you will be subject to, and responsible for complying with, all terms and conditions outlined within the Booking. This includes, but is not limited to, cancellation policies and any supplementary rules, regulations, policies, or requirements identified within the Listing or at the time of payment that pertain to the Booking. It is your sole responsibility to thoroughly review and comprehend these rules, regulations, policies, and requirements before securing a reservation at a Restaurant.
Cancellations, Client Issues & Booking Changes
Cancellation
Cancellation policies are specific to each Restaurant and are established by them through their respective Listings. As a general principle, in the event you choose to cancel or modify a Booking, the applicable terms will be dictated by the cancellation policy associated with that specific Booking.
Booking Changes
Modifications to existing bookings may be initiated through the Butler platform (“Booking Changes”). While Butlers and Restaurants are responsible for implementing mutually agreed-upon changes, all such modifications are contingent upon restaurant availability and explicit approval. Butler does not guarantee that all Booking Change requests will be honored.
Your Responsibilities
A. User Conduct
Independent Responsibility
You are solely responsible for your own actions and inactions (“acts and omissions”) when using the Butler platform. This includes the acts and omissions of any individual for whom you make a reservation.
Booking for Minors
If you book a reservation for a minor (someone below the legal age of majority), you must have legal authorization to act on their behalf. Alternatively, the minor must be accompanied by their legal guardian throughout the dining experience.
Handling of Personal Data
As a Butler, you may be required to collect and process clients' personal data, such as their name and phone number, to facilitate reservations. You must handle this information with confidentiality and in strict compliance with applicable data protection laws. Personal data must only be used for the intended purpose and should not be shared, stored, or processed beyond what is necessary for the reservation. Any misuse, unauthorized disclosure, or mishandling of client data is strictly prohibited and may result in legal action under applicable law.
B. Commission Collection Process
Commission Earning
A confirmed booking made by a Butler and accepted by a Restaurant constitutes the Restaurant’s agreement to pay a minimum commission of 10% of the final bill total to the Butler. A 1% platform fee will be deducted from this commission as a Butler platform fee.
Commission Collection Process
To collect a commission, the Butler must visit the restaurant where the reservation was made and scan the QR code provided by the restaurant manager. Upon scanning the QR code, the Butler will be presented with details including the Reservation ID, Commission Amount, Butler Platform Fee and the final amount payable to the Butler.
Before confirming the transaction, the Butler is required to carefully review all displayed details to ensure their accuracy, accept the terms and conditions presented, and click on “Confirm & Receive Commission” to finalize the transaction.
Once this action is taken, the transaction becomes final and cannot be edited or reversed, making it essential for the Butler to verify the accuracy of all details before proceeding.
If any discrepancies are noted in the commission amount or other details, the Butler must refrain from confirming the transaction and contact the Butler Platform Support Team via the Dispute option to resolve the issue. Accepting the terms during this process signifies the Butler’s acknowledgment of the accuracy of the displayed details and agreement to the platform’s policies regarding commission collection. In the event of issues such as an inability to scan the QR code, discrepancies in the displayed amount, or any other technical or process-related challenges, the Butler must immediately contact the Butler Platform Support Team for assistance.
The Butler Platform assumes no liability for errors resulting from incorrect information entered by either the restaurant or the Butler. It is the Butler’s responsibility to verify all details before confirming a booking and to promptly report any issues to the Support Team.
Yo Book functions exclusively as the platform provider, connecting Butlers and Restaurants, and therefore bears no responsibility for collecting commissions from Restaurants. Yo Book does not operate as a payment collection agent.
Butler Platform Fee
The Butler Platform applies a 1% platform Fee on the 10% commission earned by Butlers for each successful booking. This fee is automatically deducted upon confirmation of the transaction by the restaurant. The platform fee is a critical component that allows Butler to sustain its operations, enhance its technological infrastructure, and offer continuous improvements to ensure a seamless experience for its users.
The platform fee is non-negotiable and applies uniformly to all Butlers to maintain fairness and transparency within the community. Comprehensive details regarding the platform fee deductions, along with the remaining earnings, are accessible via the Butler account dashboard. This transparency ensures that Butlers can monitor their commissions and platform fee deductions accurately.
It is important to note that the 1% platform fee is Butler's sole charge. No additional or hidden fees are imposed, allowing Butlers to retain the remaining 9% of the total bill amount as their earnings. The fee structure is designed to strike a balance between supporting the platform's operational needs and maximizing the earnings potential of Butlers.
The Butler Platform reserves the right to modify the platform fee with prior notice. Any changes to the fee structure will be communicated clearly, and continued use of the platform constitutes acceptance of the updated terms.
Super Butler
The status of Super Butler is awarded to Butlers who meet a set of predetermined criteria over a 90-day period, recognizing their exceptional service and hospitality. These criteria include the number of reservations made and the absence of no-shows.
Evaluation of Super Butler Status
The evaluation of Super Butler status occurs every 3 months on the following dates: January 1st, April 1st, July 1st, and October 1st. On each evaluation date, we assess your performance based on the number of reservations made and the absence of no-shows. If all criteria are met, you will retain or be granted Super Butler status until the next evaluation. If not, improvement recommendations will be provided.
The verification process may take up to 5 business days, so the status could be granted as late as the 6th day of the month.
The Race
The Race is a loyalty and reward system accessible only to Super Butlers. This competition, which lasts three months, starts on the same dates as the status evaluations (January 1st, April 1st, July 1st, October 1st) and proceeds as follows:
- Participation To participate in the Race, you must be a Super Butler. Your performance over the three-month period will determine your position in the Race.
- Performance Tracking We track your performance in real-time, evaluating the number of reservations you make, customer satisfaction, the punctuality of your clients, and other relevant criteria.
- Ranking At the end of each three-month period, the performances of the Super Butlers are ranked, the top three performers receive rewards based on their results.
Acceptance of these Terms
You must complete the registration form and agree to the terms of this agreement before you can access or use the service. By accepting this agreement or accessing or using the service, you represent and warrant that: (a) you are at least 18 years old and have the legal capacity to be bound by this agreement; (b) You are legally permitted to use the service and receive rewards; (c) You represent and warrant that all information you submit to the Butler platform in connection with the service is true and accurate. Access to and use of the service is subject to the Butler Privacy Policy available at Butler Privacy Policy which policy is incorporated herein by reference.
We reserve the right to update this agreement at any time, at our sole discretion, and we will notify you of such updates by email or by posting such changes on our application or website, or by any other reasonable means. The date of the last modification is indicated above. It is your responsibility to check the application or web page frequently to ensure that you are aware of any changes to this agreement. Such changes will be effective immediately upon posting. If you do not agree to the revised terms and conditions, your sole recourse is to cancel your account and cease all use of the service. Your continued access to and use of the Service following notification of an updated version of this agreement constitutes your acceptance of the revised agreement. By accepting the Butler Terms of Service, you consent to Butler using your name, identifiers, and approved testimonials for promotional purposes. This may include featuring your name as a commission recipient in sales materials, marketing campaigns, and other promotions, whether in written, electronic, or oral form. Additionally, a brief description of the reward you received (commissions earned from restaurants for referring customers) may be used in these promotional materials.
Your active participation in the Butler service can thus be recognized and promoted as part of our marketing efforts, helping to strengthen the visibility and reputation of our platform. If you have any specific concerns about the use of your information for these purposes, please refer to our privacy policy available at Butler Privacy Policy for more information on how we manage your personal data.
Use of the Service
You agree that you will NOT directly or indirectly:
- Use the Service in a manner or for a purpose other than those expressly permitted by this Agreement;
- Use the Service in violation of any applicable laws or regulations;
- Copy, distribute, distribute or link to any of the Rewards without our prior written consent;
- Share your login ID, password or otherwise allow a third party to access or use your account or that of another user;
- Reproduce, duplicate, copy, sell, resell, rent, lease, exploit any part of the Service, use of the Service or access to the Service without our prior written consent;
- Use the Service to store or transmit content that is counterfeit, defamatory, offensive, pornographic, obscene or otherwise objectionable, illegal or harmful;
- Use the Service to store or transmit malicious code, viruses, Trojan horses or worms of a destructive nature or likely to harm or damage the Site, the Service and/or our computer systems;
- Disrupt the use or enjoyment of the Service by other users;
- Attempt to gain unauthorized access to the Service or the account of another user or any associated system or network;
- Copy the design of the user interface, workflow or any features of the Site and/or Service or use any of these elements for purposes other than those defined in the Service;
- Modify, publish, transmit, reproduce, create derivative works, distribute, display, link, frame with other content or incorporate into another website the Site and/or the Service, in whole or in part;
- Take screenshots or videos of the Site and/or the Service in order to share the information with one of our competitors or a company seeking to create and/or offer services similar to the Service;
- Impersonate a person or company that we are;
- Use the Service to infringe the copyrights or other intellectual property rights of third parties;
- Modify, adapt or hack the Site and/or the Service or modify another website in such a way as to falsely give the impression that it is associated in any way with us, the Site and/or the Service;
- Abuse or threaten (including threats of abuse or retaliation) in any way any of our employees, officers or other affiliates by verbal, physical, written or other means;
- Download, post or transmit unsolicited emails, SMS or "spam" messages;
- Duplicate, copy or reuse any part of our platform without our prior written consent (Respect our copyrights and ask for our permission before any duplication, copying or reuse of our platform).
Changes & Updates to the Service
Continuous Service Improvement
The Butler platform strives to continually improve the user experience. This may involve adjustments, the introduction of new features, or the addition of valuable content. We reserve the right to update, modify, or discontinue features, content, or other service aspects at any time, with or without prior notice. Our discretion in this regard is absolute.
Benefits and Availability
Please note that the availability of the Butler service and its associated benefits cannot be guaranteed. These elements are subject to change at any time without notice. However, any new features introduced will be subject to the terms outlined in this Agreement.
User Account(s)
Account Registration
To obtain access to the Service as a Butler member, you must complete an application form available in the application. Once confirmed, Butler will provide you with login credentials to use the service by email. When registering as a user, you must comply with the conditions set out in the “Acceptance” section above, including: (a) providing true, accurate, current and complete information about yourself as requested by the registration form for the Service, (b) promptly updating such information throughout the term of the contract to keep it true, accurate, current and complete.
Account Security
Only you can use your username and password. You are solely responsible for maintaining the confidentiality of your user account password and you agree not to disclose this password to any other user or third party or allow a third party to use the Service on your behalf. You must contact us immediately if you suspect any misuse of your user account or any security breach in the Service. Please note that you are responsible for all activities occurring through your user account, whether or not you have authorized these activities.
Cancellation & Termination
Duration
This Agreement is in effect, and you will have continuous access to the Service until the occurrence of any of the following events: (I) we terminate your account; or (II) you terminate your account in accordance with the provisions of this Agreement (“Duration”).
Termination
You are solely responsible for terminating your account in accordance with the provisions of this Agreement. You may terminate your account at any time by sending us an email at support@yobook.ma all terminations will be processed within 30 days of receiving the termination request.
We reserve the right to terminate this Agreement and your rights to access and use the Service for any reason or no reason, without liability, at our sole discretion and at any time, including if we suspect that you have violated the provisions of this Agreement. We will attempt to inform you of any such termination, but we are not obligated to do so.
Additionally, without limiting the rights of termination above, we reserve the right, at any time and in our sole and absolute discretion, to temporarily suspend access to the Service (in whole or in part) without liability to you for: (a) planned or unplanned maintenance; (b) the security and/or integrity of the network, hardware, or systems associated with Butler or its third-party providers; (c) a failure of any of our partners to timely pay service fees or comply with agreements with us; or (d) the actual or alleged violation of this Agreement by you.
Effect of Termination
Upon termination of this Agreement or your account, all rights granted to you under this Agreement will immediately cease, and you will lose access to the Service, discontinuing all use of the Service.
Third Party Service & Content
The Site and the Service may include features that connect you to third parties or provide you with access to third party content, such as websites, directories, servers, networks, systems, information, databases, software, applications, programs, products and/or services, as well as the entire Internet. When using a third-party website or service linked to the Site and/or the Service, you are interacting directly with that third party, and not with us.
Linked websites are not under our control, and we are not responsible for the content of these sites or the links they may contain. This also includes changes or updates to these websites managed by third parties. The presence of a link to another website does not constitute an endorsement of that site (or its products, services or other content) by us or our licensors, whether or not that link is associated with a listing on our Site.
Security Measures
We take the security of your personal data seriously and implement industry-standard security measures, including SSL encryption, to protect your information. However, please be aware that no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.
Ownership Rights
With respect to the Service and our Site, all rights, titles and interests, including associated intellectual property rights, are owned and reserved by us. If you provide us with any feedback, suggestions or other feedback on the Service, you grant us a worldwide, royalty-free, irrevocable and perpetual license to use and incorporate such feedback into the Service. In addition, you grant us and our third-party service providers the right to use, modify, adapt, reproduce, distribute, display and disclose any information or data that you transmit through the Service, solely to the extent necessary to provide you with the Service or as permitted by this Agreement and the Butler Privacy Policy.
Trademarks
The trademarks appearing on the Site and/or the Service are valuable assets owned and used by us to differentiate the Site and the Service. References to trademarks and service marks of other entities are for identification purposes only and are used with the permission of their respective owners. We do not claim or claim ownership or any affiliation with the trademarks or service marks of third parties on the Site and/or the Service. You agree not to use or display trademarks that you do not own without our prior written consent or the consent of the owner of such trademarks.
Electronic Communications
By signing up for the Service, you understand that we may send you communications or data about the Service, including but not limited to notices about your use of the Service (including any notices of use violations), updates, promotional information, and documents about the Service, all in electronic form via the email address or phone number you provided when you signed up. In the event that we send such communications, you will have the opportunity to opt out of receiving future messages in accordance with the terms of the Butler Privacy Policy.
Disclaimer
We provide our Service “as is”, “with all faults” and “as available”. You agree that any use of and reliance on the Service (including all information, content and/or materials contained therein or results obtained therefrom) by you is at your own risk. To the maximum extent permitted by applicable law, we make no (and we specifically disclaim all) representations or warranties of any kind, whether express, implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement. In addition, Butler does not warrant that access to the Service or the Site will be uninterrupted, error-free or free of harmful components, or that the information obtained through the Service will be accurate or reliable. Butler makes no representations or promises regarding any restaurant, especially in terms of commissions. As a result, Butler is not responsible to you for any loss or damage that may result from their actions or omissions or your inability to obtain to earn commissions.
Limitation of Liability
General Limitations
To the fullest extent permitted by law, neither Butler, its officers, employees, nor agents will be held liable for lost profits or business chances, lost data or Other indirect or unexpected damages, regardless of the cause (contract, negligence, etc.)
Third-Party Liability
Butler is not responsible for the actions, errors, or omissions of any supplier or third party. This includes any personal injury, death, property damage, or other expenses arising from their actions.
Maximum Liability Cap
In accordance with applicable law, the maximum total liability of Butler, its officers, employees, and agents to you for any losses or damages you suffer related to the service or this Agreement is capped at one thousand Moroccan dirhams (1,000 DH).
Force Majeure
Butler will not be liable or considered in breach of this Agreement for any delay or service interruption caused by events beyond its reasonable control, such as fire, natural disasters, strikes, communication disruptions, supply shortages, war, government regulations, or any other unforeseen circumstances outside its control.
Therefore, Butler will not be liable for delays, cancellations, overbooking, strikes, acts of God, or other events beyond its direct control. Additionally, Butler will not be liable for any additional charges, omissions, delays, or actions by any government or other authority.
Miscellaneous
Entire Agreement
This Agreement, together with the Butler Privacy Policy, constitutes the entire agreement between you and Yo Book with respect to your use of the Service. It supersedes all prior proposals, oral or written, negotiations, conversations, discussions or agreements between you and Yo Book relating to your use of the Service (including, without limitation, any prior versions of this Agreement).
Assignment
You may not assign this Agreement in whole or in part, by operation of law or otherwise, and any attempt to do so will be null and void. We may assign this Agreement in whole or in part at any time without notice.
No Waiver
Our failure to enforce any provision of this Agreement or our failure to exercise any of our rights or remedies under this Agreement will not be construed as a waiver or abandonment to any degree of our right to assert or rely on such provision, right or remedy in this or any other case.
Independent Contractors
This Agreement does not create a joint venture, agency or partnership between us and you; instead, the relationship between the parties is that of independent contractors. Our commitment to you under this Agreement is not exclusive, and Yo Book reserves the right to offer the Service to other parties.
No Third-Party Beneficiaries
This Agreement is for the sole benefit of you and Yo Book, and there will be no third-party beneficiaries, except as expressly provided in this Agreement.
Severability
If any provision of this Agreement is held to be invalid, illegal or unenforceable, the parties agree that such provision will be interpreted in accordance with applicable law as closely as possible to reflect the original intentions of the parties, and that the remaining provisions will remain in full force and effect.
Governing Law
This Agreement will be governed by and construed in accordance with the laws of Morocco, any dispute relating to it will be the exclusive jurisdiction of the courts of Agadir city, Morocco.
Survival of Terms
Other than your ability to access and use the Service, the rest of the terms of this Agreement will survive the termination of this Agreement.
Rewards
The term “Rewards” used in this Agreement refers to the commissions Butlers earn from restaurant partners for each completed booking secured through the Butler service. These commissions are typically determined by the total bill amount and the service type provided.
